These Terms of Service govern the use of the Pixels Pvt Ltd website and the provision of services by Pixels Pvt Ltd. By contacting us, requesting a proposal or engaging our services, you agree to these terms together with any specific terms agreed for your project.
1. Our services
Pixels provides digital services including website development, web solutions, business integrations, digital solutions, AI and automation services and related technical or creative services.
The exact scope of each project will depend on the requirements discussed and the proposal, quotation or agreement provided for that project.
2. Project enquiries and proposals
An enquiry or discussion does not create a contractual obligation for Pixels to undertake a project. Where appropriate, Pixels will provide a proposal, quotation or agreed scope describing the services to be provided.
Work will normally begin after the required scope, commercial terms and any applicable advance payment have been agreed.
3. Client responsibilities
Clients are responsible for providing accurate information, content, approvals, access credentials and other materials reasonably required to complete a project.
Delays caused by missing information, delayed approvals, unavailable third-party systems or other matters outside Pixels' reasonable control may affect project timelines.
4. Fees and payment
Fees, payment schedules and any applicable taxes or third-party costs will be specified in the relevant proposal, quotation or agreement.
Unless otherwise agreed in writing, work may require an advance payment before development or implementation begins.
5. Third-party services and integrations
Some projects may depend on third-party platforms, software, hosting providers, APIs, communication services, payment systems or other external services.
Pixels is not responsible for outages, policy changes, pricing changes, security incidents or other failures caused by third-party providers. Where a third-party service is required, the client may also be responsible for its subscription or usage costs.
6. Website and content supplied by clients
Clients remain responsible for ensuring that content, images, trademarks, documents, data and other materials they provide to Pixels are accurate and that they have the necessary rights or permissions to use them.
Pixels is not responsible for claims arising from materials supplied by a client that infringe the rights of another person or organisation.
7. Intellectual property
Unless otherwise agreed in writing, intellectual property ownership and usage rights for project deliverables will be determined by the applicable proposal, quotation or agreement.
Third-party software, frameworks, fonts, plugins, APIs and other components remain subject to their respective licences and terms.
8. AI and automation services
AI and automation systems can depend on third-party models, APIs, platforms, data sources and other technologies. While Pixels will make reasonable efforts to configure and test these systems, no AI-generated output or automated process can be guaranteed to be completely accurate or error-free.
Clients remain responsible for reviewing important information and decisions produced or supported by AI or automation systems where human review is appropriate.
9. Confidentiality
Pixels will treat confidential business information shared for the purpose of a project with reasonable care and will not knowingly disclose such information except where necessary to provide the agreed service, where authorised by the client or where required by law.
10. Warranties and limitations
Pixels will provide services with reasonable care and skill. However, websites, software, integrations and digital systems may depend on external technologies and cannot be guaranteed to operate without interruption or error in every environment.
Pixels does not guarantee that a particular website, campaign, automation or digital solution will achieve a specific commercial result unless such result has been expressly agreed in writing.
11. Cancellation and termination
Either party may request cancellation or termination of a project subject to the terms agreed for that project.
Work already completed, approved expenses and non-refundable third-party costs may remain payable following cancellation.
12. Liability
To the extent permitted by applicable law, Pixels will not be liable for indirect, incidental or consequential losses arising from the use of a website, digital solution, integration, automation or third-party service.
Any specific limitation of liability agreed for a project will be stated in the relevant project agreement or quotation.
13. Changes to services
Pixels may update or change its services, technologies and service providers from time to time. Project-specific changes will be discussed with the client where they materially affect the agreed scope.
14. Governing law
These Terms of Service are intended to be governed by the applicable laws of Pakistan, unless a different jurisdiction or governing law is expressly agreed in writing for a particular project.
15. Changes to these terms
Pixels may update these Terms of Service from time to time as its services, technology or legal requirements change. The latest version will be published on this page with the applicable update date.
